Dropcult is a product developed and operated by SmokeSpot Games, LLC (“SmokeSpot Games”, “Dropcult”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of dropcult.gg, the Dropcult game, official Discord communities, Community Engine, mobile applications, websites, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old or the minimum digital age of consent in your jurisdiction, have permission from a parent or legal guardian if required by applicable law, and comply with all applicable laws while using the Services.
We may modify these Terms from time to time. Updated versions will be posted at https://dropcult.gg/terms. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
You are responsible for maintaining accurate account information, protecting your login credentials, and all activity occurring under your account. You may not sell, transfer, or share your account without our permission. We may suspend, restrict, or terminate accounts that violate these Terms.
Unless required by law, purchases are final, virtual items have no cash value, virtual currency and content are non-transferable, and we may revoke access to virtual items when accounts are suspended or terminated.
You agree not to harass, threaten, bully, or intimidate others; promote hate speech or discriminatory content; share sexually explicit or illegal content; cheat, exploit bugs, or manipulate gameplay; attempt phishing, fraud, scams, or impersonation; spam or disrupt community discussions; distribute malware or harmful software; or violate applicable laws. Violation may result in warnings, suspension, permanent bans, or legal action.
Participation in the official Dropcult Discord server is subject to these Terms and the Community Guidelines. We may remove content, moderate conversations, restrict channels, suspend or remove users, route bug reports, and organize community feedback.
Our Services may include automated systems (“Community Engine”) that assist with player support, gameplay questions, community engagement, FAQ responses, bug routing, community moderation, community analytics, and AI-assisted responses. Community Engine responses are automated and may occasionally be inaccurate. Users should not rely on automated responses as professional, legal, medical, financial, or technical advice.
You retain ownership of content you create. By submitting content to our Services, you grant SmokeSpot Games a worldwide, non-exclusive, royalty-free license to host, reproduce, display, modify where necessary to operate the Services, distribute, and use that content for operating, improving, promoting, and supporting the Services. This includes messages, screenshots, artwork, music, videos, replays, avatars, emotes, livestream submissions, community posts, bug reports, and feedback. You represent that you have the rights necessary to submit such content.
Some Services include AI-assisted features. You are responsible for content you generate, upload, or submit using these features. We may remove AI-generated content that violates these Terms or Community Guidelines.
All intellectual property relating to Dropcult and the Services, including software, artwork, trademarks, logos, music, characters, and game assets, belongs to SmokeSpot Games or its licensors. Except as expressly permitted, you may not copy, distribute, reverse engineer, or commercially exploit any part of the Services.
The Services may integrate with third-party providers including payment processors, cloud providers, analytics services, AI providers, Discord, Apple, Google, Microsoft, Unity, PlayFab, and similar services. Those services operate under their own terms and privacy policies.
If you provide ideas, feedback, or suggestions, you grant SmokeSpot Games a perpetual, irrevocable, worldwide, royalty-free license to use them without compensation.
We may suspend or terminate access to the Services at any time for violations of these Terms, community safety, fraud, security, or other legitimate business reasons.
The Services are provided “AS IS” and “AS AVAILABLE”. To the fullest extent permitted by law, SmokeSpot Games disclaims all warranties, express or implied.
To the fullest extent permitted by law, SmokeSpot Games shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services. Our total liability shall not exceed the amount paid by you to SmokeSpot Games during the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless SmokeSpot Games, its affiliates, employees, contractors, and licensors from claims arising out of your use of the Services or violation of these Terms.
These Terms are governed by the laws applicable to SmokeSpot Games, LLC. If SmokeSpot Games changes its state of incorporation or principal place of business, these Terms shall be interpreted under the governing law designated by the company at that time.
Where permitted by law, disputes shall be resolved through binding individual arbitration. You waive the right to participate in class actions except where prohibited by applicable law.
If you believe your copyrighted work has been infringed, please contact smokespotgames@gmail.com. Include identification of the copyrighted work, identification of the allegedly infringing material, contact information, a good-faith statement, and an electronic signature.
